This Privacy Policy explains the when, how and why when it comes to the processing of your personal information in connection with Tencent Video (the “Service”), and sets out your choices and rights in relation to that information. The following is a high-level summary of the types of personal information we use:

A. Information you provide to us (either directly or through a third party)

Account registration information: You give us information about you when you set up an account to register for the Service: your name, email address, phone number, profile picture, gender, birth date and login details. If you choose to register for the Service using your social media account (such as Facebook, LINE, WeChat, QQ or Apple), your information from your social media account, including your username, profile picture, gender and birth date.

Customer support and feedback information: Relevant information that you voluntarily provide to us when you communicate with our customer service, when you give us reviews or feedback, set preferences on the “Settings” page of the Service or otherwise provide information to us through the Service.

Celebrity information: name, gender, age, personal motto, (when the WeFans feature is enabled) message content sent between you and WeFans user.

B. Information about you generated as part of the Service

We automatically collect certain data from you when you use the Service, namely:

• your IP address, Open ID, virtual user ID (VUID) and device information, including device ID, the device you use to access the Service (e.g. computer, gaming systems, smart TVs, mobile devices etc.) and its type and configuration, connection information;

• information regarding your use of the Service, such as statistics on page views, referral URLs and ad data, predicted age range and gender;

• user log and running log information (i.e. log information on all the actions that you conduct when using the Service);

• each time you interact with us, for example, if you contact our customer support team, we collect information including your name, date and time of contacting customer support, chat transcripts with customer support, your phone number (if you call us), Open ID, device ID, application version, battery level, WiFi strength, free space on device, iOS version, platform, network type, carrier, country code, and details of the ticket and error. You also have the option of providing your email address and a photo to illustrate the error;

• your search history on Tencent Video, including what content you select, what videos you watch and what videos you almost watched on Tencent Video;

• your comment and interactions information, including comment you choose to create with Tencent Video and the associated data, such as when, region, and by whom the comment was created.

• if you enable WeFans, we collect your name (when displayed in the WeFans, we show a partially masked version, e.g., only the first two and last characters are visible), your WeFans subscription choices, message content sent between you and celebrities to allow you to access and use the Service, including allowing you to create, send content, interact with the celebrities you follow and to keep the safety and security of the Service, and to perform content moderation.

• if you enable LIVE, we process certain information in connection with your use of this feature. This includes device information, region, age, VUID, nickname, profile picture, VIP status, playback behaviour, whether you have reserved a live-stream, your purchase and consumption of virtual items (including your current Tencent Video coins under your account, virtual gifting behaviour, ranking on gifting leaderboards, the number of Tencent Video coins you have gifted and who you have gifted to the most), as well as the content that you send in the LIVE room, including on-screen comments (such as “bullet chats”) and messages sent in the LIVE chatroom.

• if you click on a link that advertises the Service, we store the marketing and analytics data for that advertisement and marketing analytics data (e.g. device ID (IDFA (iOS) or Ad ID (Google)), engagement data and search terms) with your profile;

• if you provide us with your email address or phone number, we and third parties processing data on our behalf may generate advertising identifiers (such as a UID2 Token or a similar cross-publisher identifier);

• if you choose a paid subscription for the Service, we collect transaction information to facilitate your paid subscription, maintain a record of your transaction history and to display your service-related identity where applicable (Open ID, cost, product purchased, Tencent Video coins, IP address, device details and, if it is a web-based transaction, your email address);

• if you enable push notifications, we use a third party SDK to automatically collect data sufficient to deliver those notifications;

• when you are using the Service, our security feature collects (in addition to the categories of data listed above) device information including a list of installed hack software, equipment brand and model, available space on the device, and information about your internet connection including the type (WiFi/4G/3G);

• your Tencent Video account information and other personal information If you choose to participate in Chuang Asia Thailand-related activities; and

• if P2P technology is adopted for the Service by us in your jurisdiction, we will collect your IP address and access the video files cached by you, to determine proximity for P2P and for network transmission, to accelerate content delivery.

We do not collect your credit card details (name, credit card number, expiry date and billing address), which will be collected by third party payment processors instead (for example, if you choose to subscribe via in-app purchase).

Please note that Tencent Video collects Installed Application information to enable push notifications to be delivered.

C. Guest Users

If you use the Service without registering for a Tencent Video account, we will collect your device information, IP address and usage behaviour. If you use the Service without registering for a Tencent Video account via the Tencent Video mobile device app, we will also collect your device ID (IDFA (iOS) or Ad ID (Google)).

2. Cookies

We use cookies and other similar technologies (e.g. web beacons, log files, scripts and eTags) (“Cookies”) to enhance your experience using the Service. Cookies are small files which, when placed on your device, enable us to provide certain features and functionalities.

3. Children

Children under the age of 13 must not use the Service for any purpose, except where their parent or guardian has provided consent (to the extent this option is available in your jurisdiction).

We do not knowingly collect personal information from children under these ages for any purpose. If you believe that we have collected personal information of a child under the age of 13 without parental/guardian consent, or if you are the parent or guardian of the user and wish to withdraw consent, please contact us via Section 9 (Contact) and we will delete such information.

Survey information gender, age range, country or region of residency, nationality, ethnicity/race, occupation, email address, and other content you choose to provide as part of the survey response.

If you choose to participate in a survey hosted on third party platforms or otherwise conducted by third party service providers, their terms of use and privacy policy also apply to the data processed.

We use this information to:

  • better understand our users and to improve the Service.

If you choose to participate in Chuang Asia Thailand-related activities, such as voting for your favourite contestants: Tencent Video account information, name, email address, phone number, profile picture, gender, age, birth date,

If you are a celebrity on Tencent Video series or WeFans: name, gender, age, personal motto, (when the WeFans feature is enabled) message content sent between you and WeFans user

We use this information to:

  • manage celebrity partnerships; and
  • display celebrity's profile within Tencent Video series or on WeFans
  • keep the safety and security of the Service, and to perform content moderation.

It is in our legitimate interest to provide a complete content experience and ensure proper copyright attribution, to keep the safety and security of the Service and to perform content moderation.

Information generated as part of the Service

Open ID*

VUID: username, profile picture, login channel, gender, birthday, subscription status and payment status

We use this information to:

  • assign you an ID within the Service and identify and remember you when you log in to the Service;
  • store your Service data with your account; and
  • remember your subscription information to and provide the Service.

Necessary to perform our contract with you to provide the Service.

IP address*

We use this information to allow you to connect to our server and to deliver you personalised recommendations on the Service and personalised advertising if you have opted-in.

Device Information*: Device ID (IDFA (iOS) or Ad ID (Google)), the device you use to access the Service (e.g. computer, gaming systems, smart TVs, mobile devices etc.) and its type and configuration and connection information

  • to improve our services, including the functionality of the Service;
  • for security and verification purposes; and
  • to identify and address bugs and assess Service function for optimisation

We process the IDFA and Ad ID with your consent.

Information regarding your use of the Service: such as statistics on page views, referral URLs and ad data, predicted gender and age range

  • improve the accuracy of advertising display and service delivery;

  • train our algorithm for content recommendation to ensure you see content that may interest you.

WeFans information: name(displayed as a partially masked version, e.g., only the first two and last characters are visible), your WeFans subscription choices, message content sent between you and celebrities

Note on Visibility: Messages sent by celebrities are visible to all users subscribed to that celebrity

The message sent by you to celebrities is visible only to you and celebrities, which will only be made public to all users subscribed to that celebrity when quoted and replied to by them

We use your information to

  • allow you to access and use the Service, including allowing you to create, send content, interact with the celebrities you follow; and
  • keep the safety and security of the Service, and to perform content moderation.

Comments and interactions information: comment you choose to create with Tencent Video and the associated data, such as when, region, and by whom the comment was created

  • allow you to access and use the Service, including allowing you to send comment and interact with other users; and
  • keep the safety and security of the Service, and to perform content moderation.

Necessary to perform our contract with you to provide the Service.

It is in our legitimate interests to use this information to keep the safety and security of the Service, and to perform content moderation.

LIVE information: device information, region, age, VUID, nickname, profile picture, VIP status, playback behaviour, whether you have reserved a live-stream, your purchase and consumption of virtual items (including your current Tencent Video coins under your account, virtual gifting behaviour, ranking on gifting leaderboards, the number of Tencent Video coins you have gifted and who you have gifted to the most), as well as the content that you send in the LIVE room, including on-screen comments (such as “bullet chats”) and messages sent in the LIVE chatroom

Note on Visibility: When you send an on-screen comments, it will be displayed to all users in this LIVE room

When you send a message in the LIVE chatroom, your nickname, profile picture, VIP status and messages you sent will be displayed to all users in this LIVE room

Please note that to facilitate global interaction, your on-screen comments and messages may be automatically translated and displayed to users in other regions or languages.

We use your information to

  • allow you to access the Service and to utilise the LIVE, including enabling you to reserve and watch live-streams, display your profile (such as your nickname, profile picture and VIP status), participate in interactive exchanges (including sending on-screen comments and chatroom messages);
  • allow you to make LIVE-related payments, enable virtual gifting and displaying gifting leaderboards(depend on your use, only masked nickname, profile picture, ranking on gifting leaderboards, the number of Tencent Video coins you have gifted and who you have gifted to the most will be displayed); and
  • keep the safety and security of the Service, and to perform content moderation.

Necessary to perform our contract with you to provide the Service.

It is in our legitimate interests to use this information to keep the safety and security of the Service, and to perform content moderation.

User log and running log information*: log information on all the actions that you conduct when using the Service

We use this information to:

  • verify your subscription status;
  • update watching history of the same account across multiple platforms;
  • provide you with personalised recommendations on the Service;
  • improve the accuracy of advertising display and service delivery; and
  • train our algorithm for content recommendation to ensure you see content that may interest you.

It is in our legitimate interest to ensure the security of our Service and to improve our Service.

Crash reports, error logs and troubleshooting*: device model, device brand, Android OS version, Android API version, device manufacturer and version, CPU model, whether device is rooted, disk memory, SD card space, internal storage space, free space on device, connectivity and network information, current process information and process IDs on your device, IDFV, whether device jailbroken, area code,

We use this information to:

  • detect and manage technical issues and crashes (such as when the Service is not responding or has crashed unexpectedly), so that we can provide troubleshooting; and
  • improve the stability of the Service

Customer support log information: name, date and time of contacting customer support, chat transcripts with customer support, your phone number (if you call us), Open ID, application version, battery level, WiFi strength, free space on device, iOS version, platform, network type, carrier, country code, details of the ticket and error, email address and photo (if you provide us this to illustrate the error)

We use this information to:

  • provide troubleshooting, such as addressing and remediating technical issues and bugs; and
  • administer customer support services to you.

Necessary to perform our contract with you to provide and support the Service.

Search information: your search history on Tencent Video, including what content you select, what videos you watch and what videos you almost watched on Tencent Video

We use this information to improve our Service, including the functionality of the Service.

Necessary to perform our contract with you to provide the Service.

Advertising data: gender, date of birth, age range, location (IP address) and watch history (such as statistics on page views, referral URLs and ad data including device ID (IDFA (iOS) or Ad ID (Google))) and other advertising identifiers (such as UID2 Token or similar cross-publisher identifiers).

We use this information to understand your interests and to deliver personalised recommendations on the Service and advertising and marketing to you on and off the Service if you have opted-in.

You may opt out of personalised advertising as described in the “Your Right to Opt Out” section.

It is in our legitimate interest to deliver advertising and marketing to you.

We only use this information to serve you personalised advertising if you have opted-in. And you may opt out of personalised advertising as described in the “Your Right to Opt Out” section.

In certain jurisdictions we may obtain consent to processing certain data.

Marketing analytics data: your device ID (IDFA (iOS) or Ad ID (Google)), region, engagement data, watch history, payment actions, open sessions and search terms

If you click on a link or interact with content that advertises the Service, we store the marketing and analytics data for that advertisement and certain marketing analytics data with your profile.

It is in our legitimate interests to use this information to monitor the success of our advertising and marketing programs.

Transaction records: Tencent Video VIP account information, Open ID, cost, product purchased, IP address, device details and email address (if web-based transaction)

We use this information to

  • provide the services you request, including facilitating your paid subscription, maintaining a record of your transaction history; and
  • display your service-related identity where applicable (for example, VIP status);

Necessary to perform our contract with you to enable your paid subscription of the Service.

Security-related information*: list of hacking or cheating software, device operation system settings, device information including mobile phone brand, model, CPU structure, CPU model, kernel version and resolution

We use this information to:

  • provide a fair environment; and
  • solve crashes and optimise compatibility.

It is in our legitimate interests to use this information to protect the integrity of the Service and improve its operation.

Push notification data: device information (manufacturer, model, system type and version, language, ID, resolution, country code, network type, boot time, network status, RAM/ROM), network information (IP address, carrier), interactions, app version

We use this information to provide you with relevant push notifications.

For Apple users, if you choose to enable push notifications, we process this information with your consent. For Android users, you may choose to receive or reject push notifications via the in-app settings or device settings.

Email and SMS updates: your email address and phone number

We use this information to inform you about shows we’ve added which may be of interest to you via email and/or SMS.

We process this information with your consent.

P2P connection data (if and to the extent P2P technology is adopted for the Service by us in your jurisdiction): your IP address (encrypted), video file cached by you

We use this information to facilitate P2P acceleration for delivery, and determine proximity for P2P technology.

It is in our legitimate interest to use this information for network transmission and to accelerate content delivery.

Guest Users

If you use the Service without registering for a Tencent Video account, we will collect information regarding the device type (computer, gaming systems, smart TV, mobile device type) you use to access the Service, and its type, configuration and connection information. We will also collect your IP address and your usage behaviour (statistics on page views, referral URLs and ad data).

If you use the Service on your mobile device via the Tencent Video mobile device app without registering for a Tencent Video account, in addition to the above, we will also collect your device ID (IDFA (iOS) or Ad ID (Google)).

We use this information:

  • to offer personalised services and recommend shows to Guest Users to watch next (mobile device users); and
  • for data analytics (website users).

We process this information with your consent.

* For children under the age of 13, we may collect certain persistent identifiers such as those marked with an “*” prior to obtaining parent or guardian consent, for the purpose of triggering age verification and consent procedures and to support our internal operations that are integral to the Service. Any persistent identifiers collected from children under the age of 13 will not be used or disclosed for any other purposes without parent or guardian consent, and will be deleted if parent or guardian consent is not obtained.

We aggregate and anonymise the above information and use the resulting information for purposes including Service improvement, insights (including into our Services and campaigns), analytics and research.

5. How We Store and Share Your Personal Information

Pursuant to our contract with you to provide you with the Service, we may transfer data outside of the location in which you are based for the purposes described in this Privacy Policy.

Our servers for the Service are located in Singapore.  We also have support, engineering and other teams who may support the Service, including from Singapore and the People’s Republic of China. In addition, your information may be accessed from outside of where you live by our support, engineering and other teams (including Singapore and the PRC).

We may disclose your personal information to third parties for legitimate purposes subject to this Privacy Policy, including:

We are committed to maintaining the privacy and integrity of your personal information no matter where it is stored. We have information security and access policies that limit access to our systems and technology, and we protect data through the use of technological protection measures such as encryption.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will implement and maintain reasonable measures to protect your personal information, we cannot guarantee the security of the information transmitted through the Service or otherwise via the Internet; any transmission is at your own risk.

Stored with 90 days.

If the survey is hosted on third party platforms, such third party’s terms of use and privacy policy would also apply to the data.

Celebrity Information

Stored for as long as the relevant content is available on Tencent Video or strictly necessary for copyright attribution purposes.

WeFans information

Message content sent between you and celebrities is automatically and permanently deleted from our servers within 10 seconds of delivery to the recipient's device.

Moderation logs of the message content will be retained for up to 12 months.

Live information

The content that you send in the LIVE room, including on-screen comments (such as “bullet chats”) and messages sent in the LIVE chatroom will be deleted within 7 days after the livestream ends.

Moderation logs of the content that you send in the LIVE room will be retained for up to 3 months.

Where required by law, certain transaction records (such as payment status, transaction cost)may be retained for a longer period.

Comments and interactions information (excluding LIVE room content, which is described separately above)

Stored for the lifetime of your use of Tencent Video (i.e. until account deletion in accordance with your request) and then within 30 days;

If you delete your account, your comments and interactions information will be anonymised and retained as part of the content ecosystem, unless you specifically request the deletion of the content itself.

Moderation logs of the comments and interactions information will be retained for up to 12 months.

P2P connection data

Stored until you exit the Service (after which your IP address will be deleted within a few minutes).

Cookies

Stored in accordance with the Cookies policy.

Guest User data

Stored for the earlier of:

  • the lifetime of your use of Tencent Video (i.e. until account deletion in accordance with your request) and then with 30 days; or
  • if we cease operating Tencent Video in your country, your data will be deleted within 6 months from the day we cease our operations.

If we are required to retain your information beyond the retention periods set out above, for example to comply with applicable laws, we will store it separately from other types of personal information.

8. Your Rights

You have certain rights in relation to the personal information we hold about you, depending on where you are located. Some of these only apply in certain circumstances (as set out in more detail below). We must respond to a request by you to exercise those rights without undue delay and at least within one month (though this may be extended by a further two months in certain circumstances). Access

You have the right to access personal information we hold about you, how we use it, and who we share it with. You can access the personal information you have made available as part of your account by logging into your account. If you believe we hold any other personal information about you, please contact us via Section 9 (Contact).

Portability

You have the right to receive a copy of certain personal information we process about you. This comprises any personal information we process on the basis of your consent or pursuant to our contract with you, as described above in the section “How We Use Your Personal Information”. You have the right to receive this information in a structured, commonly used and machine-readable format. You also have the right to request that we transfer that personal information to another party, with certain exceptions. We will provide further information to you about this if you make such a request.

If you wish for us to transfer such personal information to a third party, please ensure you detail that party in your request. Note that we can only do so where it is technically feasible. Correction

You have the right to correct any of your personal information we hold that is inaccurate. You can access the personal information we hold about you by logging into your Service account. Erasure

You can delete your account, or remove certain personal information by logging into your Service account. If there is any other personal information you believe we process that you would like us to erase, please contact us via Section 9 (Contact).

We may need to retain personal information if there are valid grounds under data protection laws for us to do so (for example, for the defence of legal claims or freedom of expression) but we will let you know if that is the case. Where you have requested that we erase personal information that has been made available publicly on the Service and there are grounds for erasure, we will use reasonable steps to try to tell others that are displaying the personal information or providing links to the personal information to erase it too.

Restriction of Processing to Storage Only

You have a right to require us to stop processing the personal information we hold about you other than for storage purposes in certain circumstances. Please note, however, that if we stop processing the personal information, we may use it again if there are valid grounds under data protection laws for us to do so (for example, for the defence of legal claims or for another’s protection). As above, where we agree to stop processing the personal information, we will try to tell any third party to whom we have disclosed the relevant personal information so that they can stop processing it too.

Objection

You have the right to object to our processing of your personal information. We will consider your request in other circumstances as detailed below by contacting us via Section 9 (Contact).

To the extent provided by applicable laws and regulations, you may withdraw any consent you previously provided to us for certain processing activities by contacting us via Section 9 (Contact). Where consent is required to process your personal information, if you do not consent to the processing or if you withdraw your consent, we may not be able to deliver the expected service.

Announcements

We may from time to time send you announcements when we consider it necessary to do so (for example, when we temporarily suspend access to the Service for maintenance, or security, privacy or administrative-related communications). You may not opt-out of these service-related announcements, which are not promotional in nature.

Advertising

If you choose to opt-in to receive personalised advertisements, we may deliver personalised advertisements based on your interests and usage behavior. To enable personalised advertising, we share advertising identifiers (such as a UID2 Token) with our advertising partners, which allow them to recognize you across different sessions and tailor advertisements to your interests.

Your Right to Opt Out:

You have the right to opt out of personalised advertising at any time. If you opt out:

- You will still see advertisements on Tencent Video, but they will be contextual, non-personalised advertisements that are not based on your interests or usage behavior.

- We will stop sharing advertising identifiers (such as UID2 Token) that enable cross-session tracking with our advertising partners. However, we will continue to share contextual data (such as device model, country, and language) to serve non-personalised advertisements.

How to Opt Out:

- In-App Setting (iOS and Android): Go to “Settings” > “Privacy” > “Personalised Ads” and toggle off the option.

- You may also contact us here to request opt-out.

Note: The opt-out feature is currently available on the Tencent Video mobile app (iOS and Android) only.

Your browser settings may allow you to transmit a “Do Not Track” signal, “opt-out preference” signal or other mechanism for exercising your choice regarding the collection of your information when you visit various websites. Our Service recognizes the Global Privacy Control (GPC) signal, which enables you to opt-out of certain uses or disclosures of your information. If you notify us of your preference through GPC, we will honor your request only for the browser or device that sends the GPC signal. Other than GPC, we do not recognize any “Do Not Track” signals.

Marketing Communications

You may choose to stop receiving marketing promotions from us by following the instructions to unsubscribe in the emails or SMS, or you can contact us via Section 9 (Contact).

Rights under US State Laws:

Depending on where you live, you may have some or all of the rights listed below in relation to information that we have collected about you. However, these rights are not absolute, and in certain cases, we may decline your request as permitted by law.

Opt out of Sale or Sharing/Processing for Targeted Advertising. You may have a right to direct us not to sell your personal information or share or process your personal information for targeted advertising. To exercise this right, please submit a request through the following form: Do Not Sell or Share My Personal Information or follow the instructions in the “Your Right to Opt Out” section above.

Note that we do not process your information for the purposes of profiling in furtherance of decisions that produce legal or similarly significant effects (as all such terms and concepts are defined under applicable US State Laws ).

How to Exercise Your Rights

First, you may wish to log into your account and manage your data from there. Depending on where you live, you may also exercise your rights, if any, regarding other data by contacting us. We may take steps to verify your identity before complying with your request to protect your privacy and security, such as your email address or user ID, and may decline your request if we are unable to verify your identity.

Depending on where you live, you may exercise these rights yourself or you may also designate an authorized agent to make these requests on your behalf. In order for us to process the request, you must provide the authorized agent with signed written permission. We reserve the request to require the agent to verify their own identity and to confirm directly with you that you have provided the authorized agent permission to submit the request.

In addition, where applicable, you may have the right to appeal our decision regarding a request related to these rights and we will provide you with more information about our appeal process. When you submit a request or launch an appeal, we will limit our collection of your information to only what is necessary to securely fulfil your request or process your appeal. We will not require you or your authorized agent to pay a fee for the verification of your request or appeal.

Parents or guardians for children under the age of 13 can review or request deletion of their children’s personal information, or refuse to permit further collection or use of their children’s personal information, by contacting us as specified in Section 9 (Contact).

We will make every effort to address your request as quickly as possible. This does not affect your right to file a complaint with a data protection authority in your region if you believe we have violated data protection laws.
